Terms of Use
Effective date: October 30, 2026
These Terms of Use govern your use of jacksonkesecker.com (the “Site”), operated by Jackson Kesecker, REALTOR® (DRE#02196405), a real estate salesperson affiliated with KW Coastal Estates (responsible broker Mike Butson, DRE#01527814). “We,” “us” and “our” refer to Jackson Kesecker. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Listing information
Property listings on the Site are provided through an Internet Data Exchange (IDX) program by MLSListings Inc. and iHomefinder. Listings held by other brokerages are marked with the listing broker’s name. All information is deemed reliable but is not guaranteed and should be independently verified. Listings may be subject to errors, omissions, changes in price or status, prior sale or withdrawal without notice. Square footage, lot size, school assignments and other details are approximate. IDX information is provided for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify properties you may be interested in buying or renting.
No agency relationship or professional advice
Using the Site, submitting a form or contacting us does not by itself create an agency or client relationship. An agency relationship is formed only by a written agreement signed by you and KW Coastal Estates. Content on the Site, including market information, community descriptions and home value estimates, is for general information only. It is not legal, tax, financial, lending or appraisal advice, and a home value estimate is not an appraisal. Please consult the appropriate professional before making decisions.
Permitted use
You may use the Site for your personal, non-commercial real estate search. You agree not to:
- Copy, scrape, harvest or resell listing data or other Site content
- Use bots or automated tools to access the Site or submit forms
- Submit false information or information about someone else without their permission
- Interfere with the Site’s security or operation, or attempt to access restricted areas
- Use the Site for any unlawful purpose
Accounts and saved searches
Some features, such as saved searches, favorites and listing alerts, are provided by iHomefinder and may require you to create an account. You are responsible for keeping your login information secure and for activity under your account. You can unsubscribe from listing alerts at any time using the link in any alert email.
Communications
When you submit a form, you agree that we may contact you by phone, text message or email about your inquiry. Message and data rates may apply. Consent is not a condition of any purchase. You can opt out of texts at any time by replying STOP. See our Privacy Policy for how we handle your information.
Intellectual property
Except for listing data supplied through IDX and content owned by third parties, the Site’s text, photography, video, design and graphics are owned by Jackson Kesecker or used with permission, and are protected by copyright and other laws. Keller Williams®, KW® and related marks are trademarks of Keller Williams Realty, LLC. REALTOR® is a registered collective membership mark of the National Association of REALTORS®. You may not copy, modify or distribute Site content without our written permission.
Copyright concerns
If you believe content on the Site infringes your copyright, email kesecker@kw.com with a description of the work, where it appears on the Site, and your contact information. We will review it and remove infringing content where appropriate.
Third-party services and links
The Site uses and links to services we do not control, including iHomefinder, Google Maps, GreatSchools, Matterport, YouTube and social media. We are not responsible for their content, accuracy or practices, and a link is not an endorsement.
Fair housing
We are committed to the letter and spirit of federal and California fair housing laws. We do not discriminate on the basis of race, color, religion, sex, gender, gender identity or expression, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, age, genetic information, citizenship, primary language, immigration status, military or veteran status, or any other protected class.
Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability or fitness for a particular purpose. We do not guarantee that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Jackson Kesecker, KW Coastal Estates and Keller Williams Realty are not liable for any indirect, incidental, consequential or punitive damages, or for any loss arising from your use of, or reliance on, the Site or its content.
Brokerage
Each Keller Williams Realty office is independently owned and operated. If your property is currently listed with another broker, this is not intended as a solicitation.
Governing law
These Terms are governed by the laws of the State of California. Any dispute relating to the Site will be brought in the state or federal courts located in Monterey County, California.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date. Continued use of the Site means you accept the updated Terms.
